ISLAMABAD, Aug 8 (APP): The Supreme Court on Wednesday directed the Prime Minister/Chief Executive to appear on August 27 in connection with NRO implementation case. A five-member special bench comprising Justice Asif Saeed Khan Khosa, Justice Amir Hani Muslim, Justice Ejaz Afzal Khan, Justice Ijaz Ahmed Chaudhry and Justice Sh. Azmat Saeed issued notice to the Chief Executive under Section 17 of the Contempt of Court Ordinance 2003 read with Article 204 of the Constitution. The bench directed him to appear in person on next date of hearing and explain as to why the contempt of court proceedings should not be initiated against him.
The bench dictated its order after rejecting a request of Attorney General for Pakistan Irfan Qadir for grant of time to come up with positive response over its direction for implementation of para 177 and 178 in Dr Mobashir Hassan’s case.
The bench noted in its order that it had been unable to subscribe to submissions of the Attorney General (AG) over the detailed judgement in NRO case.
This implementation bench could not go to revisit the concluded judgement, the bench added after quoting a tv interview of Law Minister related to prospects of moving a review appeal against the said judgement.
Earlier, the AG apprised the bench in response to its earlier order that his efforts were underway and he was hopeful of a good outcome.
He requested the bench to defer proceedings till Eid, saying the issue might be taken up in the first week of September as all the stakeholders would be taken on board.
Citing his busy schedule before the bench seized of contempt of court matter last week, he said that he could not find time but assured that he would utilize all his energies to resolve the issue.
The AG said that media had reported that the instant issue was delayed during previous hearing so that the court could strike down the contempt law but he did not believe in such things.
He said that they had still the option of moving a review against the July 12 order.
